'use' implies a BEGIN block. Also, the DEBUG && BEGIN {} looks suspect to me. What you want instead is likely:

use constant DEBUG => 1; BEGIN { if (! DEBUG) { require CGI::Carp; import CGI::Carp qw/ fatalsToBrowser /; } }
