From a legal standpoint, you're pretty safe. However, take the case of Domino's Pizza vs Domino's Sugar ... cost the (at the time) small pizza chain a bundle to fight this in court. They eventually won, but the cost was very high.
I recommend choosing a different name. Unless you like threatening letters.
